Terms & Conditions

You must be at least 13 years old to use AugStudy. By using the Service you confirm that you are 13 or older and that the information you give us is accurate. If you are under 18, you must have a parent or guardian’s permission. Where the law where you live sets a higher age for agreeing to online services on your own (for example 14 in Quebec, or up to 16 in parts of the European Union), your parent or guardian agrees to these Terms on your behalf.

You are responsible for your account and for keeping your password secure. Do not share your account or let others use it. Tell us promptly if you think someone has accessed your account without permission. You can delete your account at any time from Settings.

You keep ownership of the notes, decks, cards, and other content you create or upload (“Your Content”). You grant us a limited licence to store, display, and process Your Content only as needed to run the Service for you (for example, saving your decks and generating study material you ask for). The licence ends when you delete the content or your account, except for copies other students made of a deck you shared publicly, which stay with them without your name.

You are responsible for Your Content. Do not upload anything illegal, harmful, hateful, or that infringes someone else’s rights, including material you do not have permission to share. If you share a deck publicly, you are allowing other users to view and copy it within the Service. We may remove content that breaks these Terms.

When using AugStudy, you agree not to:

• Harass, bully, threaten, or impersonate others.
• Cheat, exploit bugs, or use automated tools to inflate XP, gems, streaks, ranks, or battle results.
• Attempt to break, overload, reverse-engineer, or gain unauthorized access to the Service.
• Upload malware or content that violates the law or others’ rights.

Anyone can report a public deck from Explore, report a person from their profile, and block a person so they no longer see or contact each other. Reports reach us directly and we act on them.

AugStudy includes virtual items and currency (gems, XP, hearts, pets, badges, seasonal currency, and similar). These are a limited, personal licence to use features within the Service. They have no real-world monetary value, cannot be exchanged for cash, and cannot be sold or transferred outside the Service. We may adjust, expire, or remove virtual items as part of running and balancing the game. Except where the law requires otherwise, virtual items are non-refundable.

AugSuper is an optional paid membership that renews automatically until you cancel it. On the website it is billed by Stripe; in the iPhone app it is billed by Apple through the App Store and cancelled in your Apple subscription settings. You can cancel at any time and keep AugSuper until the end of the period you have paid for. We do not give partial refunds for unused time. Refunds for App Store purchases are decided by Apple under its policies. Prices and included perks may change; we will tell you about material changes before they take effect, and a price change never applies to a period you have already paid for.

Some features use AI to generate flashcards, summaries, study plans, quizzes, and chat responses. AI can be wrong or incomplete. The output is a study aid, not professional advice, and you should verify anything important. Do not rely on it for medical, legal, financial, or other professional decisions.

If you believe content on AugStudy infringes your copyright or another right, email support@augstudy.ca with: what the work is, where it appears in AugStudy, your contact details, and a statement that you believe in good faith that the use is not authorized. We remove or disable access to material that we determine infringes, tell the person who posted it, and close the accounts of repeat infringers. If you posted the material and believe the complaint is mistaken, you can reply with your reasons and we will review.

We work hard to keep AugStudy running well, but the Service is provided “as is” without warranties of any kind. We may add, change, or remove features, and we cannot guarantee the Service will always be available, uninterrupted, or error-free.

To the fullest extent allowed by law, AugStudy is not liable for indirect, incidental, or consequential damages, or for lost data, profits, or progress arising from your use of the Service. Our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid AugStudy in the 12 months before the claim and $50 CAD. Nothing in these Terms limits rights you have that cannot be limited by law, including consumer rights where you live.

If content you post or a breach of these Terms by you leads to a claim against AugStudy, you agree to cover the reasonable costs that result, including reasonable legal fees. This does not apply to anything caused by our own fault.

You can stop using AugStudy and delete your account at any time (Settings → Delete Account, or augstudy.ca/data-deletion). When an account is deleted, data is removed as described in our Privacy Policy.

If you break these Terms, we may remove content, restrict features, or suspend or end your account. We will tell you the reason unless the law or someone’s safety prevents it. If you think we got it wrong, you can appeal from the screen you see when you sign in, or by emailing support@augstudy.ca, and we will review it. In serious cases we may also take the legal steps needed to protect the Service and its users.

We may update these Terms. If we make a material change, we will tell you in the app and by email at least 14 days before it takes effect, and update the date above. Smaller clarifications take effect when posted. If you keep using the Service after a change takes effect, the new Terms apply; if you do not agree with them, you can delete your account at any time.

AugStudy is developed and operated from Canada, and is available to users around the world, including the United States, Europe, and elsewhere. It is your responsibility to make sure using the Service is lawful where you live, and to follow any local laws that apply to you.

Except where the mandatory law of your country or region gives you rights that cannot be waived, these Terms are governed by the laws of Canada and the province in which the operator resides, without regard to conflict-of-laws rules. This choice of law does not remove any consumer-protection rights you have under the mandatory law of your home country.

If any part of these Terms is found unenforceable, the rest stays in effect. We may transfer these Terms to someone who takes over the Service, and we will tell you if that happens; you may not transfer your account or these Terms to anyone else. If we do not enforce a term right away, we can still enforce it later. These Terms and the Privacy Policy are the whole agreement between you and AugStudy about the Service.
